Terms and Conditions

Preludeconnects.com (the "Site") is a private community for parents and guardians of children at Prelude Preschool of the Arts. By accessing or using our Site, you agree to comply with and be bound by these Terms and Conditions (the "Agreement"). If you do not agree to these terms, please do not use the Site.
 

1. Eligibility

You must be a parent, guardian, or authorized representative of a child attending Prelude Preschool of the Arts to register and access the member-only areas of the Site. By registering for an account, you represent and warrant that you meet this eligibility requirement.
 

2. Account Registration and Security

To access certain features of the Site, you must create an account. When registering, you agree to provide accurate and complete information, including your name, email address, and any other necessary information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. If you believe your account has been compromised, you should immediately notify us at rstorozuk@communitymusicschool.com.
 

3. Member Content and Conduct

The Site includes forums and other areas where members can post content, such as questions, comments, and replies. By posting content on the Site, you agree to the following:

  • Ownership and License: You retain ownership of the content you post, but by submitting content, you grant preludeconnects.com a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content within the Site and for the purposes of promoting the Site.

  • Acceptable Use: You agree to use the Site in a respectful, lawful, and responsible manner. You will not:

    • Post content that is defamatory, abusive, discriminatory, bullying, or otherwise harmful. This includes any form of harassment, intimidation, or targeted attacks on other members.

    • Use the Site for unlawful purposes or to violate any applicable laws or regulations.

    • Post personal information of others without their consent.

    • Engage in spamming, trolling, or other disruptive behaviors that negatively affect the experience of other members.

  • Zero Tolerance Policy: We have a zero-tolerance policy toward bullying and harassment. If you encounter or experience any form of bullying on the Site, we encourage you to report it immediately. We reserve the right to take appropriate action, including removing content, issuing warnings, and suspending or terminating accounts of users who engage in bullying or harassing behavior.

  • Moderation: We reserve the right to monitor and moderate all user-generated content. We may remove or edit any content that violates these Terms and Conditions or is deemed inappropriate, without prior notice.
     

4. Privacy and Data Collection

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Site, you consent to the data practices described in our Privacy Policy.
 

5. Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is the property of preludeconnects.com, Prelude Preschool of the Arts, or its licensors and is protected by copyright, trademark, and other intellectual property laws, unless otherwise noted. Some images used on the Site may be free for public use or licensed under open licenses (e.g., Creative Commons) and are credited accordingly. These images are made available for use on the Site, but you may not use, copy, reproduce, or distribute them outside the Site without following the terms set by the image's respective license. For images that are licensed under specific terms, please ensure you adhere to those terms. You may not use, copy, reproduce, or distribute any other content from the Site without express permission, except as permitted by these Terms and Conditions or as necessary for your personal, non-commercial use within the Site.
 

6. Limitation of Liability

The Site and all materials provided on the Site are offered "as is" and "as available," without any representations or warranties of any kind, either express or implied. We do not guarantee that the Site will be free from errors, interruptions, or viruses. To the fullest extent permitted by law, preludeconnects.com, Prelude Preschool of the Arts and the Community Music School of Springfield will not be liable for any direct, indirect, incidental, special, or consequential damages arising out of your use or inability to use the Site, even if we have been advised of the possibility of such damages. This includes, but is not limited to, any issues, disagreements, or conflicts that arise as a result of conversations, posts, or interactions in the forums or chat areas. We are not responsible for any content shared by members, nor are we liable for any emotional distress, misunderstandings, or disputes that may occur in these areas of the Site. You agree to engage respectfully and responsibly with other members. While we strive to foster a positive and supportive community, we cannot be held responsible for the interactions or behavior of individual members.
 

7. Termination of Account

We reserve the right to suspend or terminate your access to the Site at any time, for any reason, without prior notice, including if we believe you have violated these Terms and Conditions. Upon termination, your right to use the Site will immediately cease, and you agree to stop using the Site and any content you have accessed.
 

8. Changes to Terms and Conditions

We may update these Terms and Conditions from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. Any changes will be posted on this page, and we will update the "Effective Date" at the top of the page. You are responsible for reviewing these Terms periodically to stay informed of any updates.
 

9. Indemnification

You agree to indemnify and hold harmless preludeconnects.com, Prelude Preschool of the Arts and the Community Music School of Springfield, and their officers, employees, and agents from and against any claims, losses, damages, liabilities, and expenses (including attorney's fees) arising from your use of the Site or your violation of these Terms and Conditions.
 

10. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of the state of Massachusetts, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms and Conditions or the use of the Site will be resolved through binding arbitration in Springfield, Massachusetts, in accordance with the rules of [Arbitration Organization, if applicable].
